FEDERAL COURT OVERTURNS VERDICT AGAINST HILLERICH & BRADSBY CO.
IN ALUMINUM BAT CASE
LOUISVILLE, KY – (September 6, 2012) The U.S. District Court for the Western District of Oklahoma has overturned a judgment against Hillerich & Bradsby Co., maker of Louisville Slugger® baseball bats. The lawsuit claimed the company made a defective bat because it hit the ball too hard and caused a player to be injured.
The court’s opinion supports the company’s stance that there is nothing wrong with a league approved bat used as intended in a baseball game.
The maker of Louisville Slugger bats issued the following statement in response to the court’s decision:
Hillerich & Bradsby Co. is appreciative to the Federal Court in Oklahoma City for its time and thoughtful consideration of the case.
We make products that abide by all of the bat performance specifications set by baseball’s numerous governing bodies. Our people, guided by our principles, ensure our historic company plays by the rules.
Let us be clear, we never want to see anyone hurt while participating in baseball, a game played by millions and one that we love and have been part of for 128 years. Unfortunately, while extremely rare, injuries do occur in sports, including ones with batted balls. The vast majority of people who play sports fully recognize and accept those risks.
Baseball continues to be among the safest of all sports played. Our company will continue to comply with the game’s governing organizations’ rules to ensure it remains that way.
